APPLICAION under order 39 rule 1 & 2 read with section 151 CPC.
Respectfully Sheweth:-
- That the petitioner has filed the above titled Suit in this Hon’able Court in which no date of hearing has been fixed as yet.
- That the contents of the accompanying Suit may kindly be read as an integral part of this application.
- That the petitioner has a satisfactory prima facie arguable case in which every hope of its successes.
- That the balance of convenience moreover lies in favour of the petitioner & against the respondents.
- That if the interim relief which prayed for is not granted to the petitioner, the petitioner shall suffer an irreparable loss & injury.
It is therefore, most humbly & respectfully prayed that the interim stay in favour of the petitioner & against the respondent may kindly be granted during the pendency of this Suit that during the pendency of this suit, the defendant be permanently restrained from disposing the plaintiff from the suit property/ land measuring 2 Kanals 2 ¾ Marlas & 4 Kanals located in Sukh Nahar, Mouza Mehmood Booti, Near Band Road, Lahore.
Meanwhile ad-interim stay may moreover be granted.
